Terms of Service

1. Definitions & Agreement

In this document, ‘Customer’ refers to the purchaser of services and products provided by Tomorrow Box PTY LTD, the legal entity behind the brand ‘Tomorrow Box’. By making the deposit payment outlined in the issued invoice, the Customer agrees to enter into a contract with Tomorrow Box PTY LTD and accepts these Terms & Conditions. This acceptance is legally binding and confirms the Customer's commitment to the terms specified herein.

These terms apply to all contracts between Tomorrow Box PTY LTD and the Customer and are deemed incorporated into every agreement. Unless withdrawn by Tomorrow Box PTY LTD, project estimates remain open for acceptance within the specified period.

2. Project Fees & Revisions

Project estimates do not include photography services unless explicitly stated. Each project includes two rounds of revisions. Additional revisions are charged at $220 + GST, or a new estimate may be issued. Re-outputs of final images after delivery will incur a fee of $220 + GST per image.

3. Payment Terms

Accepted payment methods include EFT, PayPal, BTC, ETH, or Credit Card. Credit Card payments incur a 2.5% surcharge. Payment details are provided on Tomorrow Box invoices, and payment by cheque is not accepted. Receipt of the deposit payment is required before work begins, and no final artwork is delivered until full payment is received.

4. Property & Copyright

Ownership of any materials produced by Tomorrow Box PTY LTD will not transfer to the Customer until all payments are made. Copyright for any original content created will vest in Tomorrow Box PTY LTD. Upon full payment, the copyright for materials delivered will transfer to the Customer, except:

  • a) Unused materials not incorporated into the final product.

  • b) Models and data used to create images, tours, and animations.

  • c) Production files, which will remain the intellectual property of Tomorrow Box PTY LTD.

Tomorrow Box PTY LTD retains the right to use images and media created for promotional purposes, unless restricted by a confidentiality agreement.

5. Implied Conditions & Warranties

Tomorrow Box PTY LTD will not be liable for any direct, indirect, or incidental loss or damage, including but not limited to loss of profit, production, or reputation, arising from the performance or non-performance of obligations under this agreement.

6. Governing Law

All contracts between Tomorrow Box PTY LTD and the Customer, along with these terms, are governed by the laws of Queensland, Australia. Both parties submit to the jurisdiction of the courts and tribunals of Queensland.
